Clearday Terms of Service
These Terms of Service ("Terms") are an agreement between you and William Scott ("Clearday," "we," "us") covering your use of the Clearday iOS app (the "App"). By downloading, installing, or using Clearday, you agree to these Terms. If you don't agree, please don't use the App.
1. The license to use Clearday
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use Clearday on any Apple device that you own or control, for your own personal, non-commercial use, in accordance with Apple's App Store Terms of Service and Usage Rules. Clearday is licensed to you, not sold. We, and our licensors, retain all right, title, and interest in the App itself, apart from your own content (see "Your content" below).
2. Health disclaimer
Clearday shows day counts, streak milestones, and general information about physical changes commonly associated with stepping away from alcohol, nicotine, cannabis, gambling, sugar, or heavy social media use. This content is general and educational, drawn from publicly available information about what tends to happen for people broadly — it is not tailored to you, and it is not medical advice.
Clearday is not a medical device, and using it is not a substitute for professional care. A doctor, a therapist, or another qualified professional who knows your specific situation is always the right source of guidance about your health or how to approach stepping away from something. By using Clearday, you agree that any decision you make about your health is your own, made with appropriate professional guidance where needed, and not based solely on anything shown in this App.
If you are in crisis, or you or someone you know may be in danger, please contact a doctor, local emergency services, or another qualified professional right away. Clearday is a counter, not an emergency or crisis resource.
3. Free tier and Clearday+ subscription
Clearday is free to download and free to use, permanently, for one habit: the full counter screen, day and streak tracking, and the basic milestone list.
Clearday+ is an optional auto-renewing subscription that adds:
- Tracking more than one habit at a time, side by side
- Your entire check-in journal — the free tier keeps your most recent 7 entries visible and simply holds the rest until you subscribe; nothing is ever deleted
- Every widget size, on the Home Screen and the Lock Screen
- The data export feature
4. Subscription terms, billing, and cancellation
- Clearday+ is billed as an annual subscription at $39.99 per year (or the equivalent price for your country or region, as shown in the App before you purchase), starting with a 7-day free trial for eligible subscribers.
- Payment is charged to your Apple ID account at confirmation of purchase. For a subscription that includes a free trial, you will not be charged until the trial ends, unless you cancel first.
- Your subscription automatically renews for successive one-year terms at the then-current price unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the current period ends.
- You can manage or cancel your subscription — including during the free trial — any time in your Apple Account settings on your device (Settings → your name → Subscriptions). There is nothing to cancel with us directly, and we have no way to cancel it on your behalf.
- Any unused portion of a free trial is forfeited if you purchase a Clearday+ subscription during the trial period.
- All billing, trials, renewals, and refunds are handled entirely by Apple. We do not process payments and cannot issue refunds ourselves; refund requests are handled by Apple under its own policies at reportaproblem.apple.com.
- Prices may change from time to time. If they do, we will follow Apple's requirements for notifying subscribers before any change takes effect on an existing subscription.
5. Your content
Whatever you type into Clearday — habit names, notes, and everything else — is yours. We don't claim ownership of it, and because it never reaches us, we couldn't do much with it even if we wanted to. You're responsible for what you enter and for keeping your own copy if you want one; the export feature in Settings exists for exactly that.
6. Acceptable use
You agree to use Clearday only for its intended purpose, and not to:
- Reverse-engineer, decompile, or attempt to extract the source code of the App, except where applicable law expressly permits it
- Interfere with, disable, or attempt to circumvent the App's subscription or entitlement system
- Use the App in any way that violates applicable law
- Misrepresent your identity while contacting us for support
7. Intellectual property
The App, including its design, text, graphics, and the "Clearday" name and logo, is owned by William Scott or its licensors, and is protected by copyright, trademark, and other laws. Apple, the Apple logo, iPhone, and App Store are trademarks of Apple Inc. Nothing in these Terms transfers any of that to you beyond the limited license in Section 1.
8. Disclaimer of warranties
To the fullest extent permitted by applicable law, Clearday is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any milestone, calculation, or piece of content in the App is accurate, complete, or current for your situation. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
9. Limitation of liability
To the fullest extent permitted by applicable law, William Scott will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, arising out of or related to your use of, or inability to use, the App, even if we have been advised of the possibility of such damages. Where liability cannot be fully excluded, our total liability to you for all claims arising out of or relating to the App or these Terms will not exceed the greater of (a) the amount you paid us for Clearday+ in the 12 months before the claim arose, or (b) $20 USD. Nothing in these Terms limits any liability that cannot be limited under applicable law.
10. Termination
You may stop using Clearday at any time, simply by deleting the App; doing so also deletes its local data, as described in the Privacy Policy. We may suspend or discontinue the App, or your access to it, if you materially breach these Terms or if we discontinue Clearday generally. Because there is no account for us to close, "termination" here mainly means the license in Section 1 ending — it does not affect an active subscription, which is billed and can only be cancelled through Apple as described in Section 4. Sections that by their nature should survive termination — including Your Content, Intellectual Property, the Health Disclaimer, Disclaimer of Warranties, Limitation of Liability, and Governing Law — will survive.
11. Changes to the App or these Terms
We may update Clearday from time to time — to fix problems, add features, or otherwise — and we may update these Terms to reflect that. If we make a material change to these Terms, we'll update the "Last updated" date above. Continuing to use Clearday after a change takes effect means you accept the updated Terms; if you don't agree with a change, your recourse is to stop using the App and, if applicable, cancel your subscription as described in Section 4.
12. Governing law
These Terms are governed by the laws of the Republic of India, without regard to its conflict-of-laws principles — except that if you live somewhere whose consumer-protection laws entitle you to protections these Terms can't waive, those protections still apply to you.
13. Apple's role
Clearday is distributed through Apple's App Store, so a few additional points apply:
- These Terms are between you and us — William Scott — only. Apple is not a party to them and bears no responsibility for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection law.
- Apple is not responsible for investigating, defending, settling, or discharging any claim that the App infringes a third party's intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or on any U.S. Government list of prohibited or restricted parties, and that you are not listed on any such list.
- Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
14. Entire agreement; severability
These Terms, together with our Privacy Policy, make up the whole agreement between you and us about using Clearday, and replace any earlier versions. If any part of these Terms is found unenforceable, the rest remains in effect.
